Intel has asked the Federal Communications Commission for an expedited waiver. The goal is to keep foreign-made robots moving inside its US chip factories.
The request lands months after Washington banned the very equipment Intel says its fabs cannot run without.
What Intel is asking for
At issue are automated guided vehicles, or AGVs. These are mobile robots that move materials around a facility without a human operator.
On July 28, 2026, the FCC added “foreign-produced advanced robotic devices” to its Covered List, citing national security concerns. Mobile robots such as AGVs fell inside that definition.
Intel’s petition was formally filed in mid-October 2026 and appears in FCC docket 26-256. It does two things. It seeks clarity on how AGVs are treated under the robotics definition, and it requests approval for necessary modifications.
The company’s core argument is about time and substitutes. Intel says AGVs have been part of semiconductor manufacturing for over 20 years.
It also maintains that no validated domestic alternatives exist. Replacing the systems, the company indicates, could take several years.
The stakes, as Intel frames them, go beyond its own production line. The company asserts that any interruption in AGV use could reduce US chip output, with significant national security consequences.
How the exemption path works
The ban is not absolute. The FCC’s decision includes a Conditional Approval pathway for new models of foreign-produced advanced robotics.
Under the FCC’s framework, Conditional Approval is available only if the Department of War grants it.
Intel’s filing aligns with that pathway, which allows exceptions under specific circumstances. And there is already some precedent on the books.
As of October 2026, the Department of War had granted Conditional Approvals to certain foreign-produced AGV platforms, including Volley Automation.
Background: the Covered List
The Covered List was established under the Secure and Trusted Communications Networks Act of 2019. Its purpose is to identify equipment deemed to pose unacceptable national security risks.
Adding advanced robotics to that list marked a meaningful expansion. A tool built to scrutinize communications gear now reaches onto factory floors.
That context explains why Intel stresses the word “validated” in describing the lack of domestic options. Having a US-made robot available is one thing. Having one proven safe for a production line producing advanced chips is another.
What this means
For Intel, the immediate question is operational continuity. Its AGVs have been running in US fabs for two decades, and the company argues a forced replacement would take years, not months.
For policymakers, the petition is a test of how flexible the new robotics ban really is. The Conditional Approval pathway exists, and Volley Automation has already cleared it.
There is also a tension at the heart of US industrial policy here. Washington wants more chips made at home and wants fewer foreign components in sensitive settings. Intel’s petition highlights that those two goals can pull in opposite directions when the tools for making chips come from abroad.
The next signal to watch is the Department of War’s response, since its approval is the gating factor under the FCC framework. Docket 26-256 will be where that decision, and any public comments shaping it, shows up first.
